Can I get work authorization through DACA?

The Deferred Action for Childhood Arrivals program exists to benefit certain undocumented individuals who arrived in the United States as children. These individuals have the opportunity to obtain temporary protection from deportation.

In many cases, individuals in the DACA program will be eligible to request work authorization as well. DACA provides a legal opportunity for these individuals to contribute to society and pursue their career goals.

Eligibility for DACA and work authorization

To be eligible for DACA, you must meet specific criteria. As an application, you must have arrived in the United States before turning 16 or have been residing in the country since June 15, 2007. You must also meet either certain educational or military service requirements. If approved for DACA, you will receive temporary protection from deportation and may be eligible to apply for work authorization.

Applying for work authorization through DACA

Upon receiving DACA approval, you can apply for work authorization by submitting Form I-765, Application for Employment Authorization, along with required supporting documents and fees. The approval of work authorization will allow you to legally work in the United States for a renewable period of time, typically two years.

Renewing work authorization

Work authorization obtained through DACA is temporary and typically valid for two years. To continue working legally, you must periodically renew your DACA status and work authorization before they expire. Renewal applications involve submitting updated forms, meeting eligibility requirements and paying necessary fees.
